Important information for your charter

Charter Terms & Conditions

Please read these terms carefully before booking. By making a reservation with Tiga Yacht Charter, you agree to be bound by these terms and conditions.

1. Booking and Payment

1.1 Reservation

A booking is confirmed only when we receive your signed charter agreement and the required deposit.

1.2 Deposit

A deposit of 50% of the total charter fee is required at the time of booking. The deposit must be received within 7 days of reservation, or the booking may be cancelled.

1.3 Balance Payment

The remaining 50% balance plus any extras ordered must be paid at least 4 weeks (28 days) before the charter start date. Failure to pay the balance by this date may result in cancellation of the charter with no refund.

1.4 Payment Methods

We accept bank transfers (preferred), credit cards (3% processing fee), and cash at the base for additional costs.

1.5 Late Bookings

For bookings made less than 4 weeks before charter start, full payment is required at time of booking.

2. Cancellation Policy

2.1 Cancellation by Charterer

  • More than 60 days before charter: 50% of deposit refunded, 50% retained as administrative fee
  • 60-30 days before charter: No refund, but may reschedule to another available date within same season (subject to availability, one-time only)
  • Less than 30 days before charter: No refund and no rescheduling possible
  • No-show: Full charter fee forfeited, no refund

2.2 Cancellation Insurance

We strongly recommend purchasing travel insurance that covers charter cancellation. We can recommend specialized providers.

2.3 Cancellation by Charter Company

In the unlikely event we must cancel your charter, you will receive a full refund or alternative yacht of similar specification at no additional cost.

3. Check-In and Check-Out

3.1 Check-In

Check-in is on Saturday between 16:00 and 19:00. Late arrivals must be arranged in advance. At check-in, you must present:

  • Valid sailing license (ICC or equivalent)
  • VHF radio operator's license
  • Valid passports for all crew
  • Proof of sailing experience (CV or logbook)
  • Security deposit (cash or credit card pre-authorization)

3.2 Briefing

A comprehensive briefing is mandatory and typically takes 1-2 hours. This covers yacht systems, safety equipment, navigation, local regulations, and charter procedures.

3.3 Check-Out

The yacht must be returned to the base by Friday 18:00 for overnight stay and Saturday morning check-out by 09:00, or by prior arrangement. The yacht will be inspected for damage, cleanliness, and fuel/water levels.

3.4 Late Return

Late return without prior approval may result in charges and affect subsequent charterers. Additional day rates apply for approved extensions.

4. Security Deposit

4.1 Amount

Security deposits range from €2,000 to €3,000 depending on yacht size. This can be paid by cash or credit card pre-authorization.

4.2 Refund

The deposit is fully refundable provided the yacht is returned in the same condition as delivered, with no damage and all equipment present. Refund is typically within 7 days after check-out.

4.3 Deductions

The deposit may be used to cover:

  • Damage to yacht or equipment
  • Missing equipment or inventory
  • Excessive cleaning required
  • Outstanding marina fees or fuel
  • Traffic violations or fines
  • Loss of documents (transit log, etc.)

4.4 Damage Exceeding Deposit

If damage exceeds the security deposit, the charterer is liable for all additional costs.

5. Insurance

5.1 Included Insurance

Charter fee includes:

  • Hull and machinery insurance
  • Third party liability insurance (as required by law)

5.2 Insurance Excess

Charterer is responsible for the first €2,000-€3,000 of any claim (security deposit amount). Damage waiver insurance is available for purchase to reduce or eliminate this excess.

5.3 Not Covered

Insurance does NOT cover:

  • Damage to sails (unless due to structural failure)
  • Damage to dinghy and outboard motor
  • Lost equipment
  • Damage caused by negligence or sailing outside approved areas
  • Personal belongings

5.4 Personal Insurance

Charterers must arrange their own travel and medical insurance. We strongly recommend comprehensive travel insurance including:

  • Trip cancellation
  • Medical expenses
  • Personal liability
  • Personal belongings
  • Skipper's liability (for bareboat charter)

6. Use of the Yacht

6.1 Qualification Requirements

The nominated skipper must hold a valid sailing license recognized internationally (ICC, RYA, ASA, or equivalent) and have demonstrable sailing experience. We reserve the right to refuse handover if qualifications are inadequate.

6.2 Sailing Area

The yacht must remain within the territorial waters specified in the charter agreement. Sailing outside these areas without written permission voids insurance.

6.3 Number of Persons

The maximum number of persons aboard must not exceed the berth capacity stated in the charter agreement.

6.4 Prohibited Activities

  • Racing or competitive sailing
  • Chartering or sub-letting the yacht
  • Towing water-skiers or similar (unless approved)
  • Carrying passengers or cargo for hire
  • Illegal activities
  • Smoking below deck

6.5 Navigation

Night sailing is permitted only for qualified and experienced crews. Charterer must:

  • Observe all navigation rules and regulations
  • Use proper navigation lights
  • Monitor weather forecasts daily
  • Avoid sailing in dangerous conditions
  • Keep VHF radio operational and monitored

6.6 Pets

Pets are not permitted unless specifically agreed in writing at time of booking (subject to additional cleaning fee).

7. Maintenance and Breakdowns

7.1 Pre-Charter Inspection

The yacht is thoroughly inspected and serviced before each charter. Any defects found at check-in must be reported immediately.

7.2 During Charter

Charterer must:

  • Operate all equipment properly
  • Report any problems immediately
  • Follow instructions for repairs
  • Not attempt major repairs without authorization

7.3 Technical Support

We provide 24/7 technical support. Minor repairs may be authorized by phone. For major issues, our technician will attend as soon as possible.

7.4 Compensation

No refund is provided for minor technical issues resolved within 24 hours. For major breakdowns preventing use of the yacht for more than 24 hours, compensation is calculated on a pro-rata daily basis.

8. Fuel, Water, and Fees

8.1 Fuel

Yacht is delivered with full fuel tank. Charterer must return with full tank or pay for refueling plus service charge.

8.2 Water

Water tanks are full at delivery. Refilling is free at most marinas.

8.3 Marina Fees

All marina, port, and mooring fees during the charter are charterer's responsibility and not included in charter price.

8.4 National Park Fees

Entry fees to national parks (Kornati, Mljet, etc.) are charterer's responsibility.

8.5 Tourist Tax

Local tourist taxes are not included and must be paid at check-in or check-out as required by local regulations.

9. Liability and Responsibility

9.1 Charterer Responsibility

The charterer (skipper) is fully responsible for:

  • Safe navigation and operation of the yacht
  • Safety of all crew and passengers
  • All damage caused by improper use or negligence
  • Compliance with all maritime regulations
  • Weather-related decisions

9.2 Company Liability

Tiga Yacht Charter is not liable for:

  • Personal injury or loss of life (except due to proven negligence)
  • Loss or damage to personal belongings
  • Delays or changes to itinerary due to weather
  • Consequential losses due to breakdown
  • Third party actions or claims

9.3 Force Majeure

Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control including natural disasters, war, strikes, or government restrictions.

10. Privacy Policy

10.1 Data Collection

We collect personal information necessary for charter operations including names, contact details, sailing qualifications, and payment information.

10.2 Data Use

Your data is used only for:

  • Processing your charter booking
  • Meeting legal and insurance requirements
  • Providing customer support
  • Sending charter-related information
  • Marketing (only with your consent)

10.3 Data Protection

We maintain appropriate security measures to protect your data in accordance with GDPR and applicable privacy laws.

10.4 Data Retention

Charter data is retained for 7 years as required by maritime and tax regulations. Marketing data is kept only with your consent and can be deleted upon request.

10.5 Your Rights

You have the right to:

  • Access your personal data
  • Correct inaccurate data
  • Request deletion (subject to legal requirements)
  • Withdraw marketing consent
  • Lodge a complaint with data protection authority

10.6 Cookies

11. Disputes and Governing Law

11.1 Governing Law

These terms are governed by Polish law and international maritime law as applicable.

11.2 Jurisdiction

Any disputes shall be subject to the jurisdiction of Polish courts, except where international maritime law provides otherwise.

11.3 Dispute Resolution

We encourage resolution of any disputes through direct communication. If necessary, mediation is preferred before legal action.

12. General Provisions

12.1 Entire Agreement

These terms, together with the charter agreement and any addenda, constitute the entire agreement between parties.

12.2 Amendments

We reserve the right to amend these terms. Changes apply to new bookings made after the amendment date.

12.3 Severability

If any provision is found invalid, the remaining provisions remain in full effect.

12.4 Language

In case of any discrepancy between language versions of these terms, the English version prevails.

Acceptance

By booking a charter with Tiga Yacht Charter, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
